1. Acceptance of Terms
Welcome to AiLottoAnalyzer.com (the "Service"), owned and operated by CS Digital Entertainment LLC ("we", "us", or "our"). By accessing, browsing, or using our website, mobile application, or any related services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these Terms, you must immediately cease all use of the Service.
2. Eligibility & Age Requirements
You must be at least 18 years of age to use this Service. In jurisdictions where the legal age to purchase lottery tickets is 21 (including but not limited to Arizona, Iowa, and Louisiana), you must be at least 21 years of age. You represent and warrant that you meet the applicable age requirement in your jurisdiction. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You agree to notify us immediately of any unauthorized access or use of your account.
3. Subscription Services & Billing
We offer paid subscription tiers (Weekly, Monthly, and Annual). Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to renewal through your user profile dashboard, Stripe Customer Portal, or Google Play subscription settings. All payments are processed through third-party payment gateways (Stripe for web, Google Play Billing for Android). You authorize us to charge your selected payment method for recurring renewal fees at the then-current rate. We reserve the right to modify subscription pricing with 30 days' advance notice.
4. Prohibited Uses
You agree not to: (a) scrape, download, republish, or reverse-engineer the Service's proprietary code, historical draw databases, statistical analyses, or parameter optimization algorithms; (b) use automated data collection tools (crawlers, bots, scrapers) without prior written authorization; (c) attempt to circumvent subscription paywalls, access controls, or security measures; (d) use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law; (e) impersonate any person or entity, or misrepresent your affiliation with a person or entity; (f) interfere with or disrupt the Service's servers, networks, or infrastructure.
5. Intellectual Property
All software, source code, designs, algorithms, logo files, visual interfaces, text content, statistical models, and analytical methodologies featured on AiLottoAnalyzer.com are the exclusive property of CS Digital Entertainment LLC and are protected by applicable United States and international trademark, copyright, patent, and trade secret laws. Unauthorized reproduction, distribution, or commercial exploitation of any portion of the Service is strictly prohibited.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL ANALYTICAL TOOLS, CHARTS, GRAPHS, AILA PICKS, QUICK PICKS, FOURIER PROJECTIONS, AND STATISTICAL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL CS DIGITAL ENTERTAINMENT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES FROM LOTTERY TICKET PURCHASES, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
7. Indemnification
You agree to indemnify, defend, and hold harmless CS Digital Entertainment LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising from or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right; or (d) any lottery ticket purchases you make based in whole or in part on information obtained from the Service.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Subject to Section 9 (Arbitration & Class Action Waiver), any judicial proceeding arising from or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you irrevocably consent to such personal jurisdiction and venue.
9. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Subject to your 30-day right to opt out by emailing support@ailottoanalyzer.com within 30 days of account registration, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding individual arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. As an exception to arbitration, either party may assert an individual claim in a small claims court of competent jurisdiction. YOU AND CS DIGITAL ENTERTAINMENT LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
10. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last Updated" date and, where required, by prompting users to re-acknowledge the updated policies. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.
